Photography Terms & Conditions

Below are the Cove Creative ("Cove Creative", "Cove", "CC", "We", "Us", "Our", "the designer", "the photographer" ) standard terms and conditions for all projects. If you have any questions you would like to discuss, please do so at the beginning of the project otherwise your agreement at the commencement of any project will constitute full and total agreement with these terms. Unless otherwise stated, these policies form the basis of every/all contracts between CC and our clients.

It is vital that you ("the user", "the client", "you") take time to read through thoroughly and ensure you fully understand these terms and conditions and their implications before you agree to commence any project with Cove Creative. Please contact us if you do not understand any of the terms or conditions in this document.

Photography

RESERVATION: A signed contract and non-refundable retainer fee are required to reserve the dates and times of the photoshoot. If the shoot is rescheduled, postponed, or cancelled; or if there is a breach-of-contract by the client, the non-refundable retainer fee shall be liquidated damages to Cove Creative. The client shall also be responsible for payment for any of the Cove Creative's material charges incurred up to time of cancellation. If the Cove advises the rescheduling of the shoot do to weather concerns, the retainer will be transferred to the new date agreed upon by the client and the Cove. Reschedule requests submitted by email at least 10 business days (or earlier) preceding the scheduled shoot will be accepted and the retainer will be transferred to the new date agreed upon by the client and CC. Reschedule requests must be emailed to hello@covecreative.co and contain the client's full name, current shoot date and top 3 choices an alternate shoot date. Rescheduled dates are subject to the updated schedule and availability of Cove Creative. 

SHOOTING TIME / ADDITIONS: The client and the Cove Creative agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the client does not arrive at the appointed time for the photoshoot, shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the client.

EXPENSES INCURRED: When applicable, the client is responsible for all travel, accommodation, meal and transport costs unless provided by the client. Travel expenses within the Austin area will be the responsibility of CC however, unforeseen additional on job fees such as parking fees will be billed to the client following the shoot.

Any perishable items (food, flowers, etc) will be billed to the client,

FILM and COPYRIGHTS: The photographs produced by the Cove Creative are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the Cove Creative's explicitly written permission. If the client has purchased a USB or online gallery from Cove Creative, upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client. If the client has purchased a USB or online gallery from CC, CC grants the client permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to Cove Creative. The client must obtain written permission from the CC prior to publishing or selling the photographs.

MODEL RELEASE: The client hereby assigns Cove Creative and the photographer the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images.

LIMIT OF LIABILITY: In the unlikely event that the assigned photographer from Cove Creative is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the Cove Creative, CC will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S).

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Cove Creative's control, including but not limited to camera, hard drive, or equipment malfunction, Cove Creative liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Cove Creative is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.

CAPTURE AND DELIVERY: Cove Creative is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of Cove Creative and the photographer.

POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of Cove Creative and the photographer.

PAYMENT SCHEDULE: A non-refundable retainer fee is due at the time of signing this agreement. This retainer is 50% of the full shoot balance & will serve as a cancelation fee if the client makes the decision to cancel the shoot. The remaining balance may be paid incrementally, but must be paid in full by the date of the event/reserved shoot date. In the event that the client fails to surrender payment as specified, Cove Creative shall have the right to terminate this agreement with no further obligation, retaining any balance already paid.

These Terms and Conditions supersede all previous representations, contracts, understandings or agreements, unless specifically agreed otherwise by both Parties, in writing.
